Claimont - General Terms and Conditions
These General Terms and Conditions ("Terms") govern all quotations and proforma invoices issued by Claimont (“the Company”) to the customer (“the Customer”). Acceptance of a quotation or proforma invoice by the Customer constitutes agreement to these Terms.
Validity: Quotations and proforma invoices are valid for the period stated therein. If not specified, the validity is 20 days from the date of issue.
Pricing and Taxes: Prices are as stated in the quotation or proforma invoice and do not include taxes unless explicitly stated. Any taxes applicable shall be borne by the Customer.
Payment Terms: Payment terms are as specified in the quotation or proforma invoice. If not specified, a 100% Advance Payment is required.
Delivery: Delivery terms are as stated in the quotation or proforma invoice, in accordance with INCOTERMS 2020. The Company is not responsible for delays outside its reasonable control.
Inspection and Acceptance: The Customer must inspect the goods or services upon delivery and report any defects or non-conformance to the Company in writing within 3 days of receipt.
Limitation of Liability: The Company’s liability for claims arising out of or in connection with the goods or services shall not exceed the total amount paid by the Customer as indicated in the quotation or proforma invoice.
Intellectual Property: The Company retains all intellectual property rights in the products, designs, and materials provided unless otherwise agreed in writing.
Confidentiality: Both parties shall keep confidential all non-public information obtained from the other party and not disclose it to any third party without prior written consent.
Force Majeure: The Company is not liable for failure to fulfill its obligations due to causes beyond its reasonable control, such as natural disasters, acts of war, government actions, or transportation problems.
